Terms of Service

1. Open Source Software

The MetricStreaming software is licensed under the Apache License, Version 2.0. You may use, modify, and distribute the software in accordance with the Apache 2.0 license. The full license text is available in the project repository.

2. Cloud Service Terms

These terms govern your use of the MetricStreaming managed cloud service. By creating an account, you agree to these terms. The cloud service is separate from the open-source software and is subject to additional terms described below.

3. Acceptable Use

You agree not to:

• Use the cloud service for unlawful purposes
• Attempt to disrupt or overload the service infrastructure
• Reverse engineer the cloud service (the open-source client is freely available)
• Resell cloud service access without written authorization
• Send metrics containing personally identifiable information without appropriate consent

4. Service Availability

We target 99.9% uptime for the cloud service. Scheduled maintenance windows are communicated 48 hours in advance. Enterprise customers receive a contractual SLA with credits for downtime exceeding agreed thresholds.

5. Payment & Billing

Cloud subscriptions are billed monthly. You may cancel at any time; service continues until the end of the billing period. Refunds are not provided for partial months. Prices may change with 30 days’ notice.

6. Data Ownership

You own all metric data you send to the cloud service. We claim no ownership rights over your data. Upon account termination, you may export your data within 30 days before it is permanently deleted.

7. Limitation of Liability

To the maximum extent permitted by law, MetricStreaming’s total liability for any claims arising from the cloud service shall not exceed the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

8. Termination

Either party may terminate the cloud service relationship at any time. We reserve the right to suspend accounts that violate these terms after providing reasonable notice. The open-source software license is perpetual and unaffected by account termination.
